On Thursday, August 7th, Michigan Environmental Council, Natural Resources Defense Council (NRDC) and Sierra Club (collectively MNS) submitted an opening brief to the Michigan Court of Appeals in an appeal of the Michigan Public Service Commission’s (MPSC) decision approving special contracts between DTE Electric Company and a data center being developed by Oracle and OpenAI. The MPSC approved DTE’s contracts for the 1.4 gigawatt data center using an ex parte process, meaning that parties are unable to review and intervene in this case.
Troposphere Legal and Earthjustice are representing MNS in advocating for affected ratepayers statewide.
Sierra Club Campaign Organizer Bryan Smigielski, MEC Chief Policy Officer Charlotte Jameson, and Earthjustice Attorney Jacob Elkin discuss the matter here: Sierra Club, NRDC, and MEC Ask Court to Overturn Rushed Approval of DTE’s Oracle Data Center Contracts | Sierra Club
